IRS Penalty Abatement

What is IRS penalty abatement?
Penalty abatement is IRS relief that removes or reduces penalties added to your tax bill, such as the penalties for filing late, paying late, or missing a payroll deposit. The tax itself is still owed, but removing penalties can significantly shrink the balance. When a penalty is removed, the interest charged on that penalty generally comes off with it.
There are three main paths to relief: administrative waivers (First Time Abate and the new Automatic Exemption from Penalty), reasonable cause, and IRS error or statutory exceptions.
First Time Abate, and what's changing in 2026
First Time Abate (FTA) is the IRS's most common administrative penalty waiver. According to irs.gov, it applies to taxpayers with a clean compliance history for the prior three years (or 12 consecutive quarters for quarterly filers). That means:
- The same type of return was filed on time for the prior three years.
- No penalties were assessed in that period, except an estimated tax penalty or one that was later removed for reasonable cause or IRS error.
- You meet the other requirements, such as having filed all currently required returns and paid or arranged to pay the tax due.
New for 2026: the IRS says FTA is transitioning to a new relief called Automatic Exemption from Penalty (AEP), starting summer 2026. Under AEP, if you file or pay late but IRS records show three prior years (or 12 consecutive quarters) of timely compliance, the IRS will not assess the failure-to-file, failure-to-pay, or failure-to-deposit penalty in the first place. You'll get a notice explaining the relief, and you don't need to respond. AEP starts with 2025 tax year returns (Forms 1040, 1065, 1120) and 2026 quarterly returns (Forms 940, 941, 943, 944, 945, and CT-1), plus later periods.
So for recent returns, many people with good history may never see the penalty. For older years, or if you got a penalty notice you think AEP should have covered, a request is still needed. You can request FTA by phone or in writing, including on Form 843.
Reasonable cause relief
If you don't have a clean three-year history, or FTA was already used, the IRS may still remove penalties for reasonable cause. This means you used ordinary business care and prudence but couldn't comply because of circumstances beyond your control.
Examples include serious illness, a death in the immediate family, natural disasters, or being unable to get records. These requests depend on facts and documentation. A clear, well-documented written explanation that ties the event to the specific years and penalties makes the difference.
Which penalties can be removed?
Per irs.gov, the penalties eligible for FTA or AEP include failure to file, failure to pay, and failure to deposit, along with the partnership and S corporation late-filing penalties.
Other penalties, such as accuracy-related penalties, usually require reasonable cause or another basis. We review your transcripts to see which penalties are on each year and which relief path fits each one.
How PDJ Tax Experts helps
PDJ Tax Experts is led by Chardley Point Du Jour, an Enrolled Agent licensed by the IRS to represent taxpayers in all 50 states. For penalty cases we:
- Pull your IRS account transcripts to list every penalty by year and type.
- Check eligibility for FTA, AEP, reasonable cause, and IRS error.
- Sequence the requests so administrative relief is used on the year where it saves the most.
- Prepare and submit the request by phone, letter, or Form 843, with supporting documents.
- Appeal denied reasonable cause requests when the facts support it.
- Combine abatement with a payment plan or other resolution so the reduced balance is handled.
Penalty abatement works especially well for small business owners hit with payroll deposit penalties, and for individuals catching up on late returns.

What is First Time Abate?
First Time Abate is an IRS administrative waiver that can remove failure-to-file, failure-to-pay, and failure-to-deposit penalties for taxpayers with a clean compliance history over the prior three years (or 12 consecutive quarters). You can request it by phone or in writing, including on Form 843.
What is the IRS Automatic Exemption from Penalty (AEP)?
AEP is the new relief the IRS says begins in summer 2026. If you file or pay late but have three prior years of timely compliance, the IRS will not assess the failure-to-file, failure-to-pay, or failure-to-deposit penalty, and it sends a notice that relief was applied. It starts with 2025 tax year returns and 2026 quarterly returns.
Does penalty abatement remove interest too?
Interest on the underlying tax generally cannot be removed. Interest charged on a penalty is generally reduced when that penalty is removed.
What counts as reasonable cause?
Circumstances beyond your control that kept you from filing or paying on time despite ordinary business care, such as serious illness, a death in the family, a natural disaster, or inability to get records. Each request is judged on its facts and documentation.
Can I get penalties removed if I still owe the tax?
Yes, abatement can be requested while a balance is open. FTA generally requires that you have filed all required returns and paid, or arranged to pay, the tax due, which is often done with an installment agreement.
Can business payroll deposit penalties be abated?
Failure-to-deposit penalties are among the penalties eligible for FTA and AEP. Reasonable cause may also apply. We review the quarters involved to determine the best approach.
